BAPETEN Audience with the Directorate for Harmonization of Legislation III – Ministry of Law
Kembali 23 April 2025 | Berita BAPETEN | 18 lihatThe Nuclear Energy Regulatory Agency (BAPETEN) held an audience with the Directorate for Harmonization of Legislation III—Ministry of Law regarding preparations for the harmonization of nuclear energy sector legislation on Wednesday, April 23, 2025, at the Ministry of Law Office in Jakarta.
The audience was attended by Head of Bureau of Legal Affairs, Cooperation, and Public Communication (BHKK) Ishak; Director of Regulation of Radiation Facilities and Radioactive Materials (DP2FRZR) Mukhlisin; Director of Regulation of Nuclear Installations and Materials (DP2IBN) Nur Syamsi Syam; the Senior Radiation Supervisor Dahlia Cakrawati Sinaga; Health, Industry, and Research Regulations Manager of the DP2FRZR Sugeng Rahady; Activity Manager of the Legal Function Group Surachmat; and several related staff. The BAPETEN audience participants were welcomed by Unan Pribadi, Director of Harmonization of Legislation III, and the harmonization implementation team for draft legislation in the nuclear energy sector.
The event began with Ishak explaining the purpose of the audience: to coordinate preparations for the harmonization of legislation in the nuclear energy sector. In the 2025 fiscal year, BAPETEN plans to harmonize 14 draft regulations and 15 draft regulations prepared in previous years (releases), resulting in a total of 29 draft regulations that need to be completed. "We ask that you guide us throughout the entire process until enactment," Ishak stated.
Next, Nur Syamsi Syam provided an overview of the legislative drafting program at the DP2IBN. Specifically regarding the Nuclear Energy Bill, the initiator is currently facing challenges, given that BAPETEN's position within the coordination framework of a ministry remains uncertain. Furthermore, there are draft government regulations, draft presidential regulations, and six draft BAPETEN regulations. Three draft BAPETEN regulations are ready and will soon be submitted for harmonization, while the remaining three are scheduled for submission in August.
Mukhlisin continued, expressing his commitment to completing the draft legislation in the 2025 fiscal year. "It's indeed quite challenging, considering that only three BAPETEN regulations were enacted in 2024. Of the 19 drafts that will be submitted in stages this year, four have been technically prepared and will be submitted soon. There are also draft Minister of Finance Regulations on non-tax state revenue, draft Presidential Regulations on the National Strategic Project for the Management of Radioactive Waste and Spent Nuclear Fuel, and draft Government Regulations revising Government Regulation No. 61 of 2013."
In the discussion, Unan Pribadi stated that due to efficiency, the Directorate of Harmonization of Legislation – III has implemented many online meetings, almost 70%. Due to the large number of meetings that must be handled, online discussions are the best option considering the more flexible implementation. Regarding the draft Nuclear Energy Law, 2025 is actually the ideal momentum because it is already included in the National Legislation Program. If discussions are not completed this year, ideally, it can be pushed to the first level of discussion so that it can be continued in the following year (launch). Then, for the Draft Government Regulation revising Government Regulation No. 5 of 2021, currently its position has been submitted to the president, but there are still considerations regarding the suitability of the draft, especially the attachments related to the regulatory plan that anticipates current economic conditions. Then, for the Draft Government Regulation Revising Government Regulation No. 61 of 2013, which is a mandate from the draft Nuclear Energy Law, the submission of the progsun (drafting program) will be coordinated with the Planning Directorate of the Ministry of Law. Meanwhile, for the draft BAPETEN Regulation, 3 drafts from DP2IBN and 4 drafts from DP2FRZR are ready for harmonization. The priority drafts from the seven drafts should be submitted, and the harmonization implementation can be coordinated with the team. Furthermore, the completion of harmonization will depend on the number of laws and regulations being handled, the number of articles, and the substance regulated, as well as the involvement of related ministries/institutions. With intensive coordination, it is hoped that the implementation of harmonization of laws and regulations in the nuclear energy sector can run smoothly, and the target of enacting the planned regulations can be achieved.
